DEFINITIONS AND INTERPRETATION

In this policy, the following definitions are used:

Data – collectively all information that you submit to WebDragon Studios via the Website. This definition incorporates, where applicable, the definitions provided in the Data Protection Laws;

Company, We, Our, or Us – WebDragon Studios or any stakeholder, employee, and owner of webdragon.io

User or You – any third party with an agreement for services or any third party that accesses the Website and is not either (i) employed by us and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to us and accessing the Website in connection with the provision of such services;

Website – the website that you are currently using, webdragon.io, and any sub-domains of this site unless expressly excluded by their own terms and conditions

Business Day or Working Hours – means 10:00a.m – 5.00 p.m on any day (other than a Saturday, Sunday or a public holiday) when banks in our residential area are open for business.

Contract or Agreement – means any verbal/spoken/written contract between the Purchaser and the Supplier for the supply of Goods and/or Services in accordance with these terms & conditions.

Deliverables – means all design, documents, code, products, and/or materials developed by the Supplier or its agents, contractors, and employees as part of or in relation to the Services, including without limitation computer programs, data, reports, and specifications (including drafts).

REVISION POLICY

We provide revision depending upon the package you selected. Clients are subject to 3 free revisions and we will revise their design without any additional charges provided. Revision turnaround time would be 48-72 working hours.

REFUND POLICY / MONEY BACK GUARANTEE

• In any event, any deposited funds for a project shall not be subject to refund after delivery if the initial design concepts are approved, or a change is requested unless we cancel or terminate your contract for a reason other than your breach or non-performance.
• All refund requests will be fulfilled as per the following arrangement:
• You make a request when the initial concepts for a design are offered. However, once you approve or request changes in the initial designs, the refund offer becomes void and refund request will not be entertained.
• If a request for a refund is made before the delivery of initial design concepts, then you would be eligible for a 50% refund of the total agreed upon prices  (less 10% service & processing fee). We cannot and will not provide a full refund if the product design has been completed due to time being spent.
• If a request for a refund is made within and between 48 hours to 120 hours of design delivery, you would be eligible for 40% refund (less 10% service & processing fee).
• No refund request will be entertained after 120 hours of your initial design delivery, however since we believe in 100% customer satisfaction you`re encouraged to contact us in case of any concern.
• No refund request will be entertained if you have not taken any action on your order for 30 days after placing your order. However, if you want to reactivate your design order, you will be charged a certain fee depending on your project.
• No refund requests will be entertained after the final files have been delivered.
• For website packages no refund will be entertained once website development has been completed or once the website has been deployed live.
• For video animation packages no refund request will be entertained after the designing of the storyboard.
• All refund requests should be communicated to the support department or with both of the Co-Founders.
• For any custom packages, a refund will be applicable the same way as it is for the other packages on the website.
• For example, if you order a logo and web design service and approve the logo, you can claim a refund for the website service at the time of the initial design only.
• A refund request will need to have a valid reason which must be qualified against the design brief and customer feedback for revisions. Unless a concept has not been designed according to the brief, a refund will not be given however further revisions will be provided until complete satisfaction
• The Money-back guarantee is based on that the order is placed in good faith. Where a customer has placed design orders with more than one design agency for the same job with the intention to claim a refund, we do not consider it a good faith. In such a case we reserve the right to decline a refund request.
• All design jobs require customer feedback before finalizing the design therefore it is only fair that the customer gets involved and provides feedback in order to get the desired results.
• A 100% unique design guarantee entitles you to a re-draw if our design is to be found considerably similar to another design that may already exist. Any resemblance to an existing design will be merely a coincidence and We will not accept any responsibility or claim of any compensation in such a case. It is the client’s responsibility to get the artwork copyrighted.

HOW TO CLAIM YOUR REFUND

To assure your refund request is approved, please make sure you meet the following requirements

We will try to resolve your concern by virtue of our revision policy immediately or else will email you a refund request approval from our refund department. After the refund, all your design rights you would obtain from us terminates and you would not be able to display any version of the design sent by our company. Let us also specify that:

Since the design rights would now be transferred to the company, you agree that you will have no right (direct or indirect) to use any response or other content, work product or media, nor will you have any ownership interest in or to the same.

Working in collaboration with the Government Copyright Agencies we would share Copyright Acquisition information for the refunded designs that would restrict the re-use of the designs as original designs in the future. QUALITY ASSURANCE POLICY

In order to provide you the desired satisfaction, our designers don’t deviate from the specifications provided by you in the order. The designs are created after thorough research which ensures the design quality and uniqueness.

100% SATISFACTION GUARANTEE

We rework the ordered design and keep on revising it until you are 100% satisfied (depending upon your needs and agreed upon services). Each client may have 3 reworks of mild stature before extra compensation is needed to carry out further changes. Know that major rework requests may be subject to extra charges.

DELIVERY POLICY

All design order files are delivered to you electronically as per the date specified in the deal. An e-mail can also be sent to inform the client about their design order delivery made to their specific account area. All policies pertaining to revision & refund are subject to date and time of design order delivered. All design order files are delivered electronically as per the date specified in the agreement. We deliver all our customized design orders via e-mail within 5 to 20 days of receiving your order. We offer a RUSH DELIVERY service through which you can have your landing page website delivered to you in 3 days for $500 extra.

All written website content will be reviewed and crafted with both the client and 1 of our Co-Founders present on a meeting (Zoom or Google Meets) so that we may curate specifically to your liking and needed play of words.

RECORD MAINTENANCE

We might keep a record of your finalized design once we provide you the final files.

If you require the final files again in the future, we can send them to you at your request.

COMMUNICATION POLICY

You agree that We are not liable for any correspondence from email address (es) other than the ones followed by our own domain i.e. “..@webdragon.io” or/and any phone number that is not mentioned on our website webdragon.io should not be held responsible for any damage(s) caused by such correspondence. We only take responsibility of any communication through email address.

LIMIT OF LIABILITY

To the fullest extent permitted by law in each applicable jurisdiction, Our company, its officers, directors, shareholders, employees, affiliates and/or agents shall not be liable to you for any direct, indirect, incidental, special, punitive, exemplary or consequential damages whatsoever, including any damages resulting from (1) errors, mistakes, or inaccuracies of or in any content; (2) any personal injury or property damage related to your use of the our Services, design, product, code; (3) any unauthorized access to or use of our servers and/or any personal information and/or other information stored therein; (4) any interruption or cessation of transmission to or from us; (5) the use or display of any Content or User Content posted, emailed, transmitted, or otherwise made available via our Services; (6) events beyond the reasonable control of us, including any internet failures, equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, earthquakes, explosions, acts of God, war, terrorism, intergalactic struggles, governmental actions, orders of courts, agencies or tribunals or non-performance of third parties; and/or (7) loss of use, data, profits, goodwill, or other intangible losses, resulting from the use or the inability to use any or all of our Services.

You acknowledge and agree that these limitations of liability are agreed on allocations of risk constituting in part the consideration for our services to you, and such limitations will apply even if we have been advised of the possibility of such liabilities.

INDEMNITY

You agree to defend, indemnify and hold harmless us, its officers, directors, shareholders, employees, affiliates, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, debt and expenses (including attorneys’ fees) arising from: (1) your violation of any term of these Terms of Services or any other Terms; (2) your violation of any third party right, including any copyright, access rights, property, or privacy right, resulting from your actions or User Content and/or your use of our services, including, without limitation, actions for your benefit; and/or (3) any other type of claim that your User Platform and/or User Content caused damage to a third party.

EXCLUSIONS

The Company will assist the Client with the integration of 3rd party plugins and APIs but any third-party integration required to assist with the functionality of the website will be STRICTLY standard. The Company will not have anything to do with any third-party dealings during the development of this project. All additional work will require a separate fee agreement.
